On June 19, 2025, the Department of Territorial Development of the Kherson Regional State Administration concluded a new contract with LLC "New Heat Technologies" to construct a general practice family medicine outpatient clinic. The cost is UAH 15.3 million. The work should be completed by the end of 2026.
This is the second stage of construction of the same facility. At the first stage, which started in December 2023, the company was supposed to dismantle the old building and perform initial work for UAH 16.2 million. Both tenders were held without alternatives—the only participant and winner was LLC "New Heat Technologies."
The new medical facility should provide high-quality conditions for medical personnel and affordable assistance to community residents. According to the project, the one-story building will have all the necessary engineering communications, doctors' offices, a procedure room, a vaccination zone, and a comfortable waiting area. The installation of solar panels and a rainwater collection system is separately provided for.
According to the Center of Journalistic Investigations, despite starting construction in 2023, the facility was not completed by the end of 2024, and now a new stage has been started for another UAH 15.3 million. Thus, the cost has more than doubled, and the actual construction dates have been postponed.
In addition, earlier — in April 2025 — a tender for this very construction was already announced on Prozorro, but the winner was eliminated from the auction, and the results were canceled. This is not the first attempt to complete the facility, and each following tender becomes more expensive. At the same time, competition in the auction was either minimal or absent altogether.
The project's total cost is UAH 33.5 million, of which 21.3 million is funds approved by the European Investment Bank.
A contractor with a history
The YouControl system shows that LLC "New Heat Technologies" has been on the public procurement market since 2016. During this time, the company has cultivated more than UAH 500 million in budget funds. Since the beginning of the full-scale invasion, almost UAH 311 million has been cultivated. The lion's share—more than UAH 129 million of state funds—the company received precisely from the reconstruction of the deoccupied part of the Kherson region.
The company is registered in Zaporizhzhia; until June 9, 2010, its place of registration was Mariupol. Its authorized capital is UAH 36 thousand. The company owns only two DACIA LOGAN cars, which could potentially indicate its limited production capacity. Maksym Lobyntsev, a resident of Mariupol, is the director and beneficiary of the company.
He is the owner of two more companies, LLC "NPF UNIT" and "SERVICE COMFORT," which continue to be registered in the temporarily occupied territory of Mariupol.
LLC "New Heat Technologies" is involved in criminal proceedings for possible embezzlement of budget funds. In 2021, the prosecutor's office received a complaint about violations during the renovation of the Mariupol City Hospital. Due to the war, the case materials ended up in a territory temporarily not controlled by Ukraine, which made the investigation impossible. In 2024, the court allowed the case to be reopened based on the preserved documents.
The anti-corruption platform Anti-Corruption Vymir notes that the case concerns suspicions of forging certificates of work performed for more than UAH 8 million. Most of the fictitious contracts were concluded with enterprises controlled by the same beneficiary, Lobyntsev.
In addition, in March 2025, the Antimonopoly Committee recognized "New Heat Technologies" as a violator of the legislation protecting economic competition. The company was fined for participating in the distortion of bidding results. Decision No. 70/58-р/к was adopted by the administrative board of the Eastern Interregional Territorial Department of the AMCU.
A notice on the start of monitoring the procurement of the construction of an outpatient clinic, which is being carried out by the Department of the Western Office of the State Audit Service in the Ternopil region, was published in the Prozorro electronic system. The basis for the monitoring was the identification by the state financial control body of signs of violations of legislation in the field of public procurement, recorded in the documentation of this procedure. The official decision to start monitoring was made on June 25, 2025, by order No. 60-з of the Department of the Western Office of the State Audit Service in the Ternopil region. Monitoring covers all stages of the procurement process — conclusion and execution of contracts, as well as cancellation of tenders — and is carried out by the procurement control department of this department.
Conclusion
Monitoring the procurement for the construction of an outpatient clinic in the village of Davydiv Brid in the Kherson region revealed that key contracts were awarded to a company with a dubious reputation, which is involved in criminal proceedings, has a history of participation in anti-competitive conspiracies, and unfulfilled obligations. The lack of real competition in both tenders, the presence of related companies in the occupied territories, limited public information on the cost of work, and the overall dynamics of the project implementation have created risks for the effective use of both budgetary and international funds.
At the same time, it should be noted that on June 25, 2025, the Western Office of the State Audit Service in the Ternopil region officially began monitoring the procurement procedures (order No. 60-z). This indicates the presence of official state control over compliance with the legislation in this project.
This again emphasizes the need for proper transparency in project implementation - in particular, clear explanations of changes and systematic reporting on the progress and status of work within the current safety restrictions.
